Who can use dawnflight

You must be at least 13 to use dawnflight, and if you're under 18, you need a parent or guardian's permission. One account per person. Give accurate information and keep your password safe; you're responsible for activity on your account.

The service

dawnflight helps you wake up on time with alarms, wake-up verification, streaks and flocks. Alarms depend on your device, iOS version and settings, so we can't guarantee an alarm will always ring or that every wake-up will be verified. Don't rely on dawnflight as your only alarm for anything important. We may change, add or remove features over time.

Health and safety

dawnflight isn't medical advice or a medical device. Please read our Health & Safety notice, and use good judgment when you walk, run or meet people.

Flocks, events and meetups

Flocks and their events are created and run by users, not by dawnflight. We don't organize, supervise or verify events, meetup spots or other users. You take part at your own risk and are responsible for your own safety. Organizers are responsible for their events.

Your content and conduct

You keep ownership of what you create in dawnflight (like flock and event names). You give us permission to store, display and share it within dawnflight as needed to run the service. You agree to follow our Community Guidelines. We may remove content or suspend or close accounts that break these Terms or the Guidelines, including for cheating (faking wake-ups, spoofing location or using multiple accounts).

Gold

Gold is a feature of the app, not money. It has no cash value and can't be sold, transferred or exchanged except as the app allows (for Nursery items). You can buy gold in the app. We may correct balances that result from errors, fraud or cheating.

dawnflight Pro and purchases

dawnflight Pro is an auto-renewing subscription. The price and billing period are shown before you buy. Payment is charged to your Apple ID account when you confirm the purchase. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. You can manage or cancel your subscription in your App Store account settings. Refunds are handled by Apple under its policies.

Other in-app purchases, such as streak freezes and gold, are digital items used in the app. They're non-refundable except where Apple's policies or the law require otherwise.

Our app and your license

dawnflight, Rootin and the app's design, art, sounds and software belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use dawnflight on Apple devices you own or control, as allowed by the App Store Terms of Service. Don't copy, modify, reverse engineer or misuse the app.

Apple App Store terms

• These Terms are between you and us, not Apple. Apple isn't responsible for dawnflight or its content.
• Apple has no obligation to provide any maintenance or support for dawnflight.
• If dawnflight fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for dawnflight.
• Apple isn't responsible for any claims by you or anyone else relating to dawnflight or your use of it, including product liability claims, claims that dawnflight fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If anyone claims dawnflight infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
• You confirm that you aren't located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you aren't on any U.S. Government list of prohibited or restricted parties.
• You must follow any third-party terms that apply when you use dawnflight, such as your wireless carrier's.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you.

Disclaimers

dawnflight is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise that dawnflight will be uninterrupted, error-free or always available.

Limitation of liability

To the fullest extent permitted by law, dawnflight won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities (for example, a missed alarm, event or appointment). Our total liability for any claim relating to dawnflight is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not apply to you.

Indemnity

If you break these Terms or the law, or take part in a flock event, you agree to defend and hold dawnflight harmless from claims and costs that result, to the extent permitted by law.

Ending your account

You can stop using dawnflight and delete your account anytime in Settings. We may suspend or close accounts that break these Terms.

Disputes

These Terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts in [County], [State], except that either of us may bring a claim in small claims court.

Changes to these Terms

We may update these Terms. We'll change the date above and, for important changes, let you know in the app. If you keep using dawnflight after changes take effect, you accept the updated Terms.
